New EPO Jurisdiction re Second Medical Use Claims

The Enlarged Board of Appeal (EBA) of the European Patent Office EPO recently decided (G 2/08) on the conditions under which substances and compositions known as such are patentable if claimed for use in a novel and inventive medical treatment.

Israel joins the PMMA

As of  September 1, 2010 Israel will become the 85th member state of the Protocol for the International Registration of Marks (PMMA).

Israel may then be designated in an application for an International Registration.

EPÜ-Änderungen ab 1. April 2010

Der Verwaltungsrat der Europäischen Patentorganisation hat weitere Änderungen der Ausführungsordnung zum EPÜ beschlossen, die am 1. April 2010 in Kraft treten werden. Folgende wesentliche Neuerungen sind vorgesehen:

EPC Amendments coming into force on April 1, 2010

The Administrative Council of the European Patent Organization has decided to further amend the EPC Implementing Regulations. These amendments will come into force on April 1, 2010 and the most remarkable amendments are the following:

Beitritt Albaniens (AL) zum EPÜ

Albanien hat seinen Beitritt zum EPÜ am 11. Februar 2010 mit Wirkung zum 1. Mai 2010 beurkundet.

Da Albanien nun Mitglied des EPÜ ist, ist mit jeder internationalen Anmeldung, die am 1. Mai 2010 oder später eingereicht wird, auch die Bestimmung Albaniens zur Erlangung eines europäischen Patents automatisch erwirkt.

Die Europäische Patentorganisation umfaßt nun 37 Vertragsstaaten.

Accession to the EPC by Albania (AL)

Albania acceded to the EPC on February 11, 2010.

For Albania, the EPC will enter into force on May 1, 2010. Any International applications filed on or after May 1, 2010 will automatically include the designation of Albania for the purpose of obtaining a European patent.

The European Patent Organisation now comprises 37 member states.

Die Durchführung eines Widerspruchsverfahrens in Markensachen ist in Österreich ab dem 1. Juli 2010 möglich

Das österreichische Markenschutzgesetz (§§ 29a bis 29c) führt zum 1. Juli 2010 ein Widerspruchsverfahren ein, welches als rasches und kostengünstiges Verfahren vor allem die Rechte der Inhaber eingetragener Marken stärken und deren Durchsetzung erleichtern soll. Innerhalb von 3 Monaten ab dem Tag der Veröffentlichung der Marke im Österreichischen Markenanzeiger bzw.

From July 1, 2010 on, it will be possible to conduct Opposition Proceedings in trademark cases in Austria

Amendments to the Austrian Trademark Protection Act 1970 (Art. 29a to 29c) allow for opposition proceedings. These opposition proceedings should strengthen the rights of registered trademark owners and should facilitate enforcement of a trademark. The new law will enter into force on July 1, 2010.

Accession to the Geneva Act 1999 by Germany

The Federal Republic of Germany acceded to the 1999 Act (Geneva) of the Hague Agreement concerning the International Registration of industrial designs on November 13, 2009. The maximum duration of protection for industrial designs will be 25 years.
